G\u00fcndem gazetesi Ortado\u011fu\u2019daki milliyet\u00e7ilik, cinsiyet\u00e7ilik, dincilik ve ulus-devlet \u00e7\u0131kmaz\u0131ndan kurutulu\u015fun yol haritas\u0131n\u0131 halkalara sunan Rojava Toplumsal S\u00f6zle\u015fmesi\u2019nin (Anayasa) tam metnini yay\u0131nlad\u0131. <br \/>Rojava Toplumsal S\u00f6zle\u015fmesi&#8217;nin tam metni \u015f\u00f6yle: <\/p>\n<p><strong>G\u0130R\u0130\u015e<\/strong><\/p>\n<p>Din, dil, \u0131rk, inan\u00e7, mezhep ve cinsiyet ayr\u0131m\u0131n\u0131n olmad\u0131\u011f\u0131, e\u015fit ve ekolojik bir toplumda adalet, \u00f6zg\u00fcrl\u00fck ve demokrasinin tesisi i\u00e7in. Demokratik toplum bile\u015fenlerinin siyasi-ahlaki yap\u0131s\u0131yla birlikte \u00e7o\u011fulcu, \u00f6zg\u00fcn ve ortak ya\u015fam de\u011ferlerine kavu\u015fmas\u0131 i\u00e7in. Kad\u0131n haklar\u0131na sayg\u0131 ve \u00e7ocuk ile kad\u0131nlar\u0131n haklar\u0131n\u0131n k\u00f6kle\u015fmesi i\u00e7in. Savunma, \u00f6zsavunma, inan\u00e7lara \u00f6zg\u00fcrl\u00fck ve sayg\u0131 i\u00e7in. Bizler demokratik \u00f6zerk b\u00f6lgelerin halklar\u0131  K\u00fcrtler, Araplar, S\u00fcryaniler (Asuri, Keldani ve Arami), T\u00fcrkmenler ve \u00c7e\u00e7enler olarak bu s\u00f6zle\u015fmeyi kabul ediyoruz.<\/p>\n<p>Demokratik \u00d6zerk B\u00f6lge Y\u00f6netimleri  ulus-devleti, askeri ve dini devlet anlay\u0131\u015f\u0131n\u0131, ayn\u0131 zamanda merkezi y\u00f6netimi ve iktidar\u0131 kabul etmez.<\/p>\n<p>Demokratik \u00d6zerk B\u00f6lge Y\u00f6netimleri  b\u00fct\u00fcn etnik, toplumsal, k\u00fclt\u00fcrel ve ulusal olu\u015fumlar\u0131n kendilerini kurumlar\u0131 arac\u0131l\u0131\u011f\u0131yla ifade etmeleri i\u00e7in toplumsal mutabakata, demokrasiye ve \u00e7o\u011fulculu\u011fa a\u00e7\u0131kt\u0131r. Demokratik \u00d6zerk B\u00f6lge Y\u00f6netimleri  ulusal ve uluslararas\u0131 bar\u0131\u015fa, Suriye\u2019nin s\u0131n\u0131rlar\u0131na ve insan haklar\u0131na sayg\u0131l\u0131d\u0131r.<\/p>\n<p>Toplumsal S\u00f6zle\u015fme\u2019nin olu\u015fmas\u0131, demokratik toplumun in\u015fas\u0131n\u0131n arac\u0131 ve toplumsal adaletin g\u00fcvencesi olan Demokaratik \u00d6zerkli\u011fin tesisi ve bilimsel bir toplumun in\u015fas\u0131 i\u00e7in  Demokratik \u00d6zerk Y\u00f6netimler\u2019deki K\u00fcrtlerin, Araplar\u0131n, S\u00fcryanilerin, Ermenilerin ve \u00c7e\u00e7enlerin istemleri ile Suriye\u2019nin di\u011fer halklar\u0131n\u0131n istemleri demokratik bir Suriye ve Demokratik \u00d6zerk Y\u00f6netimler\u2019in siyasi-toplumsal bir sistem olmas\u0131nda birle\u015fti. Bu ama\u00e7lar ve b\u00f6yle bir y\u00f6netim i\u00e7in bu s\u00f6zle\u015fme kabul edilmi\u015ftir.<\/p>\n<p><strong>B\u0130R\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/p>\n<p><em><strong>Temel unsurlar:<\/strong><\/em><\/p>\n<p>1. Madde: <br \/>Bu anla\u015fman\u0131n ad\u0131, Demokratik \u00d6zerk Kanton Y\u00f6netimleri\u2019nin (Ciz\u00eer, Koban\u00ea ve Efr\u00een) Toplumsal S\u00f6zle\u015fmesi\u2019dir. Demokratik \u00d6zerk Y\u00f6netimlerin Toplumsal S\u00f6zle\u015fmesi\u2019nin i\u015flemesi ve ilerlemesi bu s\u00f6zle\u015fmenin bir par\u00e7as\u0131d\u0131r ve ondan ayr\u0131lamaz.<\/p>\n<p>2. Madde:<br \/>a) \u0130ktidarlar\u0131n kayna\u011f\u0131 halkt\u0131r, halk iktidar\u0131n sahibidir, se\u00e7imle belirledi\u011fi kurumlar\u0131 ve meclisleri arac\u0131l\u0131\u011f\u0131yla y\u00f6netimini sa\u011flar. Demokratik \u00d6zerk Y\u00f6netimler\u2019in Toplumsal S\u00f6zle\u015fmesi\u2019nin d\u0131\u015f\u0131nda kalan y\u00f6netimlerin hi\u00e7biri me\u015fru de\u011fildir.<br \/>b) Demokrasi temeli \u00fczerinde kurulmu\u015f olan meclis ve y\u00fcr\u00fctme kurullar\u0131n\u0131n kayna\u011f\u0131 halkt\u0131r. Bunlar\u0131n tek elde veya z\u00fcmrede toplanmas\u0131 kabul edilemez.<\/p>\n<p>3. Madde:<br \/>a) Suriye \u00f6zg\u00fcr, demokratik ve ba\u011f\u0131ms\u0131z bir devlettir. Suriye, parlamenter, federal, \u00e7o\u011fulcu ve demokratik bir sisteme sahiptir.<br \/>b) Demokratik \u00d6zerk Kanton Y\u00f6netimleri (Ciz\u00eer, Koban\u00ea ve Efr\u00een) Suriye topraklar\u0131n\u0131n bir par\u00e7as\u0131d\u0131r ve Qami\u015flo kenti de Demokratik \u00f6zerk Ciz\u00eer kantonunun merkezidir.<br \/>c) Ciz\u00eer Kantonu ortak kantondur ve i\u00e7erisinde K\u00fcrtler, Araplar, S\u00fcryaniler, Ermeniler ve \u00c7e\u00e7enler ile \u0130slam, H\u0131ristiyan ve \u00cazid\u00ee inan\u00e7lar\u0131 birlikte ya\u015farlar. Bu da karde\u015flik ve ortak ya\u015fam temelinde ger\u00e7ekle\u015fir.<br \/>d) Bu s\u00f6zle\u015fme Demokratik \u00d6zerk kantonlar\u0131n Y\u00f6netimleri i\u00e7in temel te\u015fkil ediyor ve Ge\u00e7ici Yasama Meclisi t\u00fcm kantonlar\u0131n temsilcili\u011fini yapar.<\/p>\n<p>4. Madde: Kantonlarda Demokratik \u00d6zerk Y\u00f6netim sistemi<br \/>a- Yasama Meclisi,<br \/>b- Y\u00fcr\u00fctme Meclisi,<br \/>c- Y\u00fcksek Se\u00e7im Komiserli\u011fi,<br \/>d- Y\u00fcksek Anayasa Meclisi,<br \/>e- B\u00f6lge Meclisleri\u2019den olu\u015fur.<\/p>\n<p>5. Madde: Qami\u015flo kenti Ciz\u00eer kantonunun merkezidir ve y\u00f6netimidir<\/p>\n<p>6. Madde: Demokratik \u00d6zerk Y\u00f6netimlerde her \u015fah\u0131s ve olu\u015fum erk ve haklar bak\u0131m\u0131ndan yasalar \u00f6n\u00fcnde e\u015fittir.<\/p>\n<p>7. Madde: Toplumsal S\u00f6zle\u015fme\u2019yi kabul eden Suriye\u2019deki b\u00fct\u00fcn kentler ve b\u00f6lgeler, Demokratik \u00d6zerk Y\u00f6netimlerin kantonlar\u0131na dahil olma hakk\u0131na sahiptir.\u00a0 <\/p>\n<p>8. Madde: Demokratik \u00d6zerk Y\u00f6netimlerin t\u00fcm kantonlar\u0131  her t\u00fcrl\u00fc b\u00f6lgesel faaliyetlerini y\u00fcr\u00fctme, \u00f6zg\u00fcr iradeleriyle y\u00f6netim ve meclislerini kurma ve Toplumsal S\u00f6zle\u015fme\u2019ye ayk\u0131r\u0131 olmayan her t\u00fcrl\u00fc hakk\u0131 kullanma hakk\u0131na sahiptir.<\/p>\n<p>9. Madde: Ciz\u00eer kantonunun resmi dilleri K\u00fcrt\u00e7e, Arap\u00e7a ve S\u00fcryanice\u2019dir. Ayn\u0131 zamanda di\u011fer t\u00fcm olu\u015fumlar\u0131n anadillerini kullanma ve anadillerinde e\u011fitim g\u00f6rme hakk\u0131 vard\u0131r.<\/p>\n<p>10. Madde: Demokratik \u00d6zerk Kanton Y\u00f6netimleri hi\u00e7bir devletin i\u00e7i\u015flerine kar\u0131\u015fmaz, kom\u015fuluk haklar\u0131n\u0131 savunur ve sorunlar\u0131 da bar\u0131\u015f yoluyla \u00e7\u00f6zmeyi esas al\u0131r.<\/p>\n<p>11. Madde: Demokratik \u00d6zerk Kantonlar bayrak, amblem ve mar\u015flar\u0131n\u0131 belirleme hakk\u0131na sahiptir. Bunlar ilgili yasalarla d\u00fczenlenir.<\/p>\n<p>12. Madde: Demokratik \u00d6zerk Y\u00f6netim, siyasi merkeziyet\u00e7i olmayan gelecek Suriyesi\u2019nin bir par\u00e7as\u0131 ve \u00f6rne\u011fidir. Suriye i\u00e7in federal sistem en uygun sistem oldu\u011fundan dolay\u0131 \u00f6zerk y\u00f6netim ile merkez (merkezi devlet) aras\u0131ndaki ili\u015fkiler bu temel \u00fczerine kurulur.<\/p>\n<p><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><br \/><em><strong><br \/>Temel unsurlar:<\/strong><\/em><\/p>\n<p>13. Madde: Bu s\u00f6zle\u015fmede yasama, hukuk ve y\u00f6netim erkleri birbirinden ayr\u0131d\u0131r. (G\u00fc\u00e7ler ayr\u0131l\u0131\u011f\u0131 ilkesi)<\/p>\n<p>14. Madde: \u00d6zerk y\u00f6netim  g\u00fcn\u00fcn adalet \u00f6l\u00e7\u00fclerine g\u00f6re, rejimin daha \u00f6nce b\u00f6lge halk\u0131na kar\u015f\u0131 geli\u015ftirmi\u015f oldu\u011fu t\u00fcm \u0131rk\u00e7\u0131 projelerini kald\u0131rarak, zarar g\u00f6ren yurtta\u015flar\u0131n zararlar\u0131n\u0131 telafi eder.<\/p>\n<p>15. Madde:<br \/>a- Halk Savunma Birlikleri (YPG) ulusal bir kurum olarak her \u00fc\u00e7 kantonun g\u00fcvenli\u011finden ve toprak savunmas\u0131ndan sorumludur. Halk\u0131n \u00e7\u0131karlar\u0131na hizmet eder ve halk\u0131n g\u00fcvenli\u011fi ile \u00e7\u0131karlar\u0131n\u0131 korur. YPG \u00f6zsavunma ilkesine g\u00f6re hareket eder, merkezi ordu ile ili\u015fkilerini Yasama Meclisi\u2019nin \u00e7\u0131kard\u0131\u011f\u0131 yasalar belirler. \u0130\u00e7 g\u00fcvenli\u011fe ve merkezi sisteme y\u00f6nelik tehditlere kar\u015f\u0131 da sivil y\u00f6netimleri destekler. Emirlerini de Halk Savunma Birlikleri\u2019nden (YPG) al\u0131r.<br \/>b- Asayi\u015f G\u00fc\u00e7leri \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131\u2019na ba\u011fl\u0131d\u0131r.<\/p>\n<p>16. Madde: Y\u00f6netimleri g\u00f6zetmeyen, d\u0131\u015far\u0131da b\u0131rakan ve adalet \u00f6l\u00e7\u00fclerini a\u015fan yasalar\u0131n \u00e7\u0131kar\u0131lmas\u0131 yasakt\u0131r.<\/p>\n<p>17. Madde: Toplumsal S\u00f6zle\u015fme, t\u00fcm yasalarda gen\u00e7lerin siyasete ve y\u00f6netime g\u00fc\u00e7l\u00fc bir \u015fekilde kat\u0131l\u0131mlar\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131r.<\/p>\n<p>18. Madde: Su\u00e7lar ve cezalar ilgili yasalarla d\u00fczenlenir.<\/p>\n<p>19. Madde: Vergi ve vergilendirme ilgili yasalarla d\u00fczenlenir.<\/p>\n<p>20. Madde: \u0130nsan Haklar\u0131na dair uluslararas\u0131 t\u00fcm anla\u015fma ve s\u00f6zle\u015fmeler Toplumsal S\u00f6zle\u015fme\u2019de bir i\u00e7 hukuk normu olarak ge\u00e7erlidir.<\/p>\n<p><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/p>\n<p><em>H<strong>ak ve \u00d6zg\u00fcrl\u00fckler:<\/strong><\/em><\/p>\n<p>21. Madde: Y\u00f6netimler, uluslararas\u0131 anla\u015fma ve s\u00f6zle\u015fmelere g\u00f6re insan haklar\u0131n\u0131 ve de\u011ferlerini g\u00fcvence alt\u0131na al\u0131r. Y\u00f6netimlerde en de\u011ferli \u015fey ki\u015fi ve gruplar\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcd\u00fcr.<\/p>\n<p>22. Madde: Evrensel \u0130nsan Haklar\u0131 Bildirgesi\u2019nin sivil, siyasi, k\u00fclt\u00fcrel, toplumsal, ekonomik maddeleri ve ilgili t\u00fcm bildiriler bu Toplumsal S\u00f6zle\u015fme\u2019nin bir par\u00e7as\u0131d\u0131r.\u00a0 <\/p>\n<p>23. Madde:<\/p>\n<p>a) Herkes etnik, dil, cinsiyet, dini, mezhebi ve k\u00fclt\u00fcrel kimli\u011fini ya\u015fama hakk\u0131na sahiptir.<br \/>b) Herkes ekolojik toplum esaslar\u0131na g\u00f6re ya\u015fama hakk\u0131na sahiptir.<\/p>\n<p>24. Madde: Her ki\u015fi ve grup  d\u00fc\u015f\u00fcnce, inan\u00e7, karar ve g\u00f6r\u00fc\u015flerinde \u00f6zg\u00fcrd\u00fcr. Al\u0131nan kararlar\u0131n toplumsal bar\u0131\u015fa, ahlaka ayk\u0131r\u0131 olmamas\u0131 ve diktat\u00f6rl\u00fc\u011f\u00fc savunmamas\u0131 ko\u015fuluyla.<\/p>\n<p>25. Madde:<br \/>a) Birey \u00f6zg\u00fcrl\u00fc\u011f\u00fc esast\u0131r ve korunur, hi\u00e7 kimse yasad\u0131\u015f\u0131 olarak g\u00f6zalt\u0131na al\u0131namaz.<br \/>b) \u0130nsan onuru esast\u0131r ve korunur, hi\u00e7 kimseye fiziki ve psikolojik i\u015fkence yap\u0131lamaz. \u0130\u015fkence yapan ki\u015fi cezaland\u0131r\u0131l\u0131r.<br \/>c) Tutuklu ve h\u00fck\u00fcml\u00fcler i\u00e7in insani ya\u015fam alan\u0131 azami \u015fekilde d\u00fczenlenir ve cezaevleri, cezaland\u0131rma yerleri de\u011fil e\u011fitim ve rehabilite yerleri olarak d\u00fczenlenir.\u00a0 <\/p>\n<p>26. Madde: Toplumsal S\u00f6zle\u015fme\u2019de siyasi hayat (g\u00f6r\u00fc\u015f) hakk\u0131 g\u00fcvence alt\u0131ndad\u0131r ve idam cezas\u0131 kald\u0131r\u0131l\u0131r (yoktur).<\/p>\n<p>27. Madde: Kad\u0131nlar\u0131n siyasi, toplumsal, ekonomik, k\u00fclt\u00fcrel ve her t\u00fcrl\u00fc ya\u015fam hakk\u0131 vard\u0131r (g\u00fcvence alt\u0131na al\u0131n\u0131r)<\/p>\n<p>28. Madde: Kad\u0131nlar, \u00f6zsavunma ve her t\u00fcrl\u00fc cinsiyet ayr\u0131m\u0131n\u0131 kald\u0131rma, reddetme hakk\u0131na sahiptir.<\/p>\n<p>29. Madde: Toplumsal S\u00f6zle\u015fme, \u00e7ocuk haklar\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131r, \u00e7ocuklar\u0131n \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131, \u00e7ocuklara fiziki ve psikolojik i\u015fkence yap\u0131lmas\u0131 ve \u00e7ocuklar\u0131n k\u00fc\u00e7\u00fck ya\u015fta evlendirilmesini yasaklar.<\/p>\n<p>30. Madde: Toplumsal S\u00f6zle\u015fme\u2019de her yurtta\u015f\u0131n \u015fu haklar\u0131 vard\u0131r:<br \/>1) G\u00fcvenlik, huzur ve istikrar hakk\u0131<br \/>2) Temel e\u011fitim hakk\u0131 (zorunludur)<br \/>3) \u0130\u015f, ev, sosyal sigorta ve sa\u011fl\u0131k hakk\u0131<br \/>4) Anne ve \u00e7ocuklar\u0131n korunmas\u0131 ve beslenmesi hakk\u0131<br \/>5) Ya\u015fl\u0131lar\u0131n ve engellilerin sa\u011fl\u0131k, korunma ve sosyal hayat haklar\u0131 g\u00fcvence alt\u0131ndad\u0131r.<\/p>\n<p>31. Madde: Dini inan\u00e7lar\u0131n ya\u015fanmas\u0131 hakk\u0131 g\u00fcvence alt\u0131ndad\u0131r, dinin siyasete alet edilmesi, din \u00fczerinden kar\u015f\u0131tl\u0131k ve ayr\u0131mc\u0131l\u0131k yarat\u0131lmas\u0131 kabul edilemez.<\/p>\n<p>32. Madde:<br \/>a) Toplumsal S\u00f6zle\u015fme\u2019de parti, dernek, sendika ile sivil toplum \u00f6rg\u00fct\u00fc kurma hakk\u0131 ve bunlar\u0131n y\u00f6netime kat\u0131l\u0131m\u0131 yasalarca g\u00fcvence alt\u0131na al\u0131n\u0131r.<br \/>b) Toplumsal S\u00f6zle\u015fme\u2019de b\u00f6lgelerdeki toplumun \u00e7ok renklili\u011fi, zenginle\u015fmesi, k\u00fclt\u00fcrel geli\u015fimi, siyasi \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve ekonomik edinimleri g\u00fcvence alt\u0131na al\u0131n\u0131r.<br \/>c) \u00cazid\u00eelik inanc\u0131 ayr\u0131 bir inan\u00e7t\u0131r. \u00cazid\u00eeler her t\u00fcrl\u00fc toplumsal ve dini inan\u00e7lar\u0131n\u0131 ya\u015fama hakk\u0131na sahiptir.\u00a0 <\/p>\n<p>33. Madde: Toplumsal S\u00f6zle\u015fme\u2019de bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc, ileti\u015fim, yay\u0131nc\u0131l\u0131k ve gazetecilik faaliyetleri g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r ve d\u00fczenlemesi ilgili yasalarla yap\u0131l\u0131r.<\/p>\n<p>34. Madde: Yurtta\u015flar g\u00f6r\u00fc\u015flerini ifade etme, grev ve bar\u0131\u015f\u00e7\u0131l eylemler yapma hakk\u0131na sahiptir. Bu hak ilgili yasal d\u00fczenlemelerle belirlenir.<\/p>\n<p>35. Madde: Herkes bilgi edinme, bilimsel faaliyet y\u00fcr\u00fctme, k\u00fclt\u00fcrel ve sanatsal faaliyet y\u00fcr\u00fctme hakk\u0131na sahiptir.<\/p>\n<p>36. Madde: Herkesin se\u00e7imlerde b\u00fct\u00fcn kurumlara aday olma hakk\u0131 vard\u0131r. Bu hak ilgili yasal d\u00fczenlemelerle belirlenir.<\/p>\n<p>37. Madde: Herkesin siyasi g\u00f6\u00e7 (s\u0131\u011f\u0131nma) hakk\u0131 vard\u0131r. Siyasi s\u0131\u011f\u0131nma isteyen hi\u00e7 kimse iste\u011fi d\u0131\u015f\u0131nda geri \u00e7evrilemez.<\/p>\n<p>38. Madde: Toplumsal S\u00f6zle\u015fme herkese f\u0131rsat e\u015fitli\u011fi tan\u0131r ve g\u00fcvence alt\u0131na al\u0131r.<\/p>\n<p>39. Madde: Yeralt\u0131 ve yer\u00fcst\u00fc t\u00fcm zenginlikler b\u00fct\u00fcn toplumundur. Madde:<br \/>a- 7 \u00fcyeden olu\u015fur ve bunlardan biri ba\u015fkand\u0131r. \u00dcyeler Yasama Meclisi Ba\u015fkan\u0131 taraf\u0131ndan \u00f6nerilir.<br \/>\u00dcyeler yarg\u0131\u00e7, avukat ve d\u00fcr\u00fcst ve uzman akademisyenlerden se\u00e7ilir. Uzmanl\u0131k s\u00fcreleri 15 y\u0131ldan<br \/>a\u015fa\u011f\u0131 olmamal\u0131d\u0131r.<br \/>b- Y\u00fcksek Anayasa Mahkemesi \u00fcyesi, ayn\u0131 zamanda ba\u015fka bir g\u00f6revde bulunamaz, Yasama<br \/>Meclisi\u2019nin \u00fcyesi olamaz. Bunlar ilgili yasayla d\u00fczenlenir.<br \/>c- Y\u00fcksek Anayasa Mahkemesi \u00fcyelerinin g\u00f6rev s\u00fcresi d\u00f6rt y\u0131ld\u0131r, yaln\u0131zca bir defaya mahsus olmak kayd\u0131yla uzat\u0131labilir.<br \/>Y\u00fcksek Anayasa Mahkemesi\u2019nin g\u00f6revleri:<br \/>1- Anayasa\u2019y\u0131 yorumlar.<br \/>2- Yasama Meclisi\u2019nden \u00e7\u0131kar\u0131lan yasalar\u0131n anayasaya uygunlu\u011funu inceler, karara ba\u011flar.<br \/>3- Y\u00fcr\u00fctme Meclisleri, Yasama Meclisleri ve kurumlar aras\u0131ndaki anayasal sorunlara bakar.<br \/>4- Kanton y\u00f6neticisi, Yasama Meclisi \u00fcye ve y\u00f6neticilerinin Toplumsal S\u00f6zle\u015fme\u2019ye ayk\u0131r\u0131 fiillerinin<br \/>olmas\u0131 durumunda yarg\u0131lama yapar.<br \/>5- Kararlar\u0131n\u0131 oy \u00e7oklu\u011fuyla al\u0131r.<\/p>\n<p>78. Madde: Yolsuzluk ve ilgili su\u00e7lar d\u0131\u015f\u0131nda Y\u00fcksek Anayasa Mahkemesi \u00fcyeleri g\u00f6revlerinden<br \/>uzakla\u015ft\u0131r\u0131lamaz. \u0130\u015fleri kendi i\u00e7 t\u00fcz\u00fc\u011f\u00fcne g\u00f6re y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>79. Madde: Y\u00fcksek Anayasa Mahkemesi, anayasaya ayk\u0131r\u0131 yasal d\u00fczenlemeleri \u015fu \u015fekilde belirler:<br \/>1) Anayasaya ayk\u0131r\u0131 yasalar hakk\u0131nda kararlar\u0131n al\u0131nmas\u0131:<br \/>a- Bir yasa \u00e7\u0131kar\u0131lmadan \u00f6nce e\u011fer Yasama Meclisi\u2019nin \u00fcyelerinin y\u00fczde 20\u2019si o yasaya kar\u015f\u0131<br \/>\u00e7\u0131karsa, Y\u00fcksek Anayasa Mahkemesi 15 g\u00fcn i\u00e7erisinde s\u00f6zkonusu yasa hakk\u0131nda karar\u0131n\u0131 vermelidir. E\u011fer yasa aciliyet arzediyorsa bu s\u00fcre 7 g\u00fcnd\u00fcr.<br \/>b- Kararname (yasa teklifi) Yasama Meclisi\u2019ne sunulup okunduktan sonraki 15 g\u00fcn i\u00e7erisinde<br \/>e\u011fer meclis \u00fcyelerinin y\u00fczde 20\u2019si kar\u015f\u0131 ise, mehkeme 15 g\u00fcn i\u00e7erisinde bunu da karara ba\u011flamak<br \/>zorundad\u0131r.<br \/>c- Y\u00fcksek Anayasa Mahkemesi, yasan\u0131n tamam\u0131n\u0131n ya da baz\u0131 bendlerinin (f\u0131kralar\u0131n\u0131n) anayasaya<br \/>ayk\u0131r\u0131 oldu\u011funa karar verdiyse  anayasaya ayk\u0131r\u0131 olan t\u00fcm meddeleri reddedilir\/geri \u00e7evrilir.<br \/>2) Anayasaya ayk\u0131r\u0131 olan yasalarda ayk\u0131r\u0131l\u0131k tespit edildikten sonra \u015fu \u015fekilde karar verilir:<br \/>a- Bir davada taraflardan biri savunmas\u0131nda herhangi bir yasan\u0131n anayasaya ayk\u0131r\u0131 oldu\u011funu<br \/>belirtirse Y\u00fcksek Anayasa Mahkemesi bunu hemen g\u00f6rmeli ve bunun hakk\u0131nda karar\u0131n\u0131 vermelidir. O mahkeme de davay\u0131 durdurup dosyay\u0131 Y\u00fcksek Anayasa Mahkemesi\u2019ne havale etmelidir.<br \/>b- Y\u00fcksek Anayasa Mahkemesi bu savunma hakk\u0131nda 30 g\u00fcn i\u00e7erisinde karar vermelidir.<br \/>\u00a0<br \/><em><strong>Genel Kararlar<\/strong><\/em><\/p>\n<p>80. Madde: Bu Toplumsal S\u00f6zle\u015fme Demokratik \u00d6zerklik Y\u00f6netimi\u2019nde ge\u00e7erlidir. Yasama Meclisi\u2019nin \u00fc\u00e7te ikisinin (23) oylar\u0131yla de\u011fi\u015ftirilebilir.<\/p>\n<p>81. Madde: Bu s\u00f6zle\u015fme Yasama Meclisi\u2019nin de\u011ferlendirilmesi ve kabul edilmesi i\u00e7in sunulur.<\/p>\n<p>82. Madde: Suriye kimli\u011fi d\u0131\u015f\u0131nda herhangi bir kimli\u011fe sahip olanlar  kanton y\u00f6neticili\u011fi, meclis ba\u015fkanl\u0131\u011f\u0131, dan\u0131\u015fmanl\u0131k ve Y\u00fcksek Anayasa Meclisi \u00fcyeli\u011fi yapamaz.<\/p>\n<p>83. Madde: Bu s\u00f6zle\u015fme bir yasayla kararlar\u0131n\u0131 ve ola\u011fand\u0131\u015f\u0131 yasalar\u0131 d\u00fczenler.<\/p>\n<p>84. Madde: Bu s\u00f6zle\u015fme, Yasama Meclisi taraf\u0131ndan onayland\u0131ktan 4 ay sonra, Yasama Meclisi bu s\u00f6zle\u015fmenin g\u00f6zetiminde\/g\u00fcvencesinde ilk se\u00e7imlerini de yapar. \u015eu anda g\u00f6rev g\u00f6ren Ge\u00e7ici Yasama Meclisi \u015fartlara g\u00f6re bu bu tarihi uzatabilir.<\/p>\n<p>85. Madde: Demokratik \u00d6zerklik Y\u00f6netimi\u2019nin hukuki yemini: Tanr\u0131 (Allah) ad\u0131na yemin ederim<br \/>ki bu Toplumsal S\u00f6zle\u015fme\u2019ye ve onun yasalar\u0131na soyg\u0131 duyaca\u011f\u0131m. Ben halk\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve \u00e7\u0131karlar\u0131n\u0131 savunaca\u011f\u0131m. Demokratik \u00d6zerklik Y\u00f6netimi b\u00f6lgelerinin g\u00fcvenli\u011fini, \u00f6zsavunmas\u0131n\u0131 ve demokrasisini koruyaca\u011f\u0131m. Demokratik ulusa olan inanc\u0131mla toplumsal adalet i\u00e7in m\u00fccadele edece\u011fim.<\/p>\n<p>86. Madde: Kad\u0131n temsil oran\u0131 t\u00fcm kurum, y\u00f6netim ve kurullarda y\u00fczde 40\u2019tan az olmamal\u0131d\u0131r.<\/p>\n<p>87. Madde: Suriye\u2019nin var olan ve toplumsal s\u00f6zle\u015fmeye ayk\u0131r\u0131 olmayan yasalar\u0131 (idari ve ceza) kullan\u0131l\u0131r.<\/p>\n<p>88. Madde: \u00d6zerk Y\u00f6netim ile merkezi y\u00f6netim yasalar\u0131 aras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kt\u0131\u011f\u0131 durumlarda<br \/>konu Y\u00fcksek Anayasa Mahkemesi\u2019ne havale edilir.<\/p>\n<p>89. Madde: Bu s\u00f6zle\u015fme yurtta\u015flar\u0131n da yard\u0131m\u0131yla do\u011fa haklar\u0131n\u0131 savunur ve do\u011fan\u0131n korunmas\u0131n\u0131<br \/>ahlaki, ulusal ve erdemli bir g\u00f6rev olarak g\u00f6r\u00fcr.<\/p>\n<p>90. Madde: E\u011fitim y\u00f6ntemleri ve m\u00fcfredat\u0131nda da siyasetten uzakla\u015ft\u0131rma, \u0131rk\u00e7\u0131 ve \u015foven kavramlar\u0131<br \/>kald\u0131r\u0131l\u0131r. Bunlar\u0131n yerine toplumsal \u00e7ok renklilik ve \u00e7ok k\u00fclt\u00fcrl\u00fcl\u00fc\u011f\u00fc koyar.<br \/>a- Yeni e\u011fitim m\u00fcfredat\u0131nda \u00f6zerk b\u00f6lgelerin tarihi, k\u00fclt\u00fcrleri, halklar\u0131, co\u011frafyalar\u0131 ve zenginlikleri<br \/>tan\u0131t\u0131l\u0131r.<br \/>b- E\u011fitim y\u00f6ntemleri  ileti\u015fim ara\u00e7lar\u0131n\u0131, bilimsel kurumlar\u0131, insan haklar\u0131 k\u00fclt\u00fcr\u00fcn\u00fc ve demokratik,<br \/>bilimsel k\u00fclt\u00fcr\u00fc esas al\u0131r.<\/p>\n<p>91. Y\u00f6netimler t\u00fcm din, inan\u00e7 ve mezheplere sayg\u0131l\u0131d\u0131r. Y\u00f6netimler ibadet \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc savunur.<\/p>\n<p>92. Madde: K\u00fclt\u00fcrel, toplumsal ve ekonomik d\u00fczeni sa\u011flamak ve ileriye g\u00f6t\u00fcrmek y\u00f6netimlerin<br \/>birincil g\u00f6revidir.<\/p>\n<p>93. Madde: Ola\u011fan\u00fcst\u00fc durumlar: Kanton Y\u00f6neticisi\u2019nin belirlendi\u011fi Y\u00fcr\u00fctme Meclisi toplant\u0131s\u0131nda \u00fcyelerin \u00fc\u00e7te iki (2\/3) oyuyla ola\u011fan\u00fcst\u00fc hal belirlenebilir veya kald\u0131r\u0131labilir.
