T\u00fcrk s\u00f6m\u00fcrgeci rejiminin<br \/>\n\u0131srarla sorunu ter\u00f6r  d\u00fczleminde ele almas\u0131 me\u015frulu\u011funa g\u00f6lge d\u00fc\u015f\u00fcrme<br \/>\namac\u0131ylad\u0131r. AB, ABD gibi g\u00fc\u00e7lerde bu sorunun kayna\u011f\u0131n\u0131 ve m\u00fccadelenin<br \/>\nme\u015frulu\u011funu bilmekte fakat siyasi ve ekonomik \u00e7\u0131karlar\u0131 gere\u011fi uluslararas\u0131<br \/>\nhukukun K\u00fcrtler\u2019 e tan\u0131nmas\u0131 noktas\u0131nda iki y\u00fczl\u00fc bir tutum sergilemektedirler.<\/p>\n<p> BM Genel Kurulu 24 Ekim 1970<br \/>\ntarihli ve 2625 say\u0131l\u0131 karar\u0131yla halklar\u0131n direnme sava\u015f\u0131n\u0131 hukuken tan\u0131m\u0131\u015ft\u0131r.<br \/>\n12 A\u011fustos 1949 tarihli Cenevre S\u00f6zle\u015fmesine ek uluslararas\u0131 \u00e7at\u0131\u015fmalara<br \/>\nili\u015fkin \u201977 tarihli birinci protokol\u00fcn \u00bc maddesi gelece\u011fini kaderini belirleme<br \/>\nhakk\u0131 \u00e7er\u00e7evesinde s\u00f6m\u00fcrgeci \u00fcst\u00fcnl\u00fc\u011fe, yabanc\u0131 i\u015fgaline ve \u0131rk\u00e7\u0131 rejimlere<br \/>\nkar\u015f\u0131 m\u00fccadele eden halklar\u0131n silahl\u0131 \u00e7at\u0131\u015fmas\u0131n\u0131 uluslararas\u0131 \u00e7at\u0131\u015fma olarak<br \/>\nde\u011ferlendirmektedir. Uluslararas\u0131 planda kabul edilen bir\u00e7ok s\u00f6zle\u015fme de<br \/>\nhalklar\u0131n ve gruplar\u0131n hak gasp\u0131 durumunda ba\u015fvuraca\u011f\u0131 yollar silahl\u0131 savunmay\u0131<br \/>\n\/ sava\u015f\u0131 da i\u00e7ermektedir. Fakat hi\u00e7bir halk, s\u0131n\u0131f veya grup zorunlu olmad\u0131k\u00e7a<br \/>\nsava\u015f\u0131 ve silahl\u0131 m\u00fccadeleyi tercih etmez. Sava\u015f anacak s\u00f6m\u00fcr\u00fcc\u00fc ya da<br \/>\ns\u00f6m\u00fcrgeci\/i\u015fgalci h\u00e2kim sistemlerin halklara, s\u0131n\u0131flara veya gruplara farkl\u0131<br \/>\nbir \u00e7\u00f6z\u00fcm yolu b\u0131rak\u0131lmad\u0131\u011f\u0131nda g\u00fcndeme gelir. Bunun ad\u0131 da me\u015fru savunma<br \/>\nhakk\u0131n\u0131n kullan\u0131lmas\u0131 olmaktad\u0131r.<\/p>\n<p> PKK ile geli\u015fen K\u00fcrdistan<br \/>\nDevrimci Halk Sava\u015f\u0131 ger\u00e7e\u011fi bu perspektifle ele al\u0131nmal\u0131 ve<br \/>\nde\u011ferlendirilmelidir. K\u00fcrdistan\u2019da me\u015fru savunma temelinde geli\u015fen devrimci<br \/>\nhalk sava\u015f\u0131 ko\u015fullar\u0131 ve nedenlerini K\u00fcrt Halk \u00d6nderli\u011fi \u015f\u00f6yle ortaya koymaktad\u0131r.<strong> \u201cKavram olarak devrimci halk sava\u015f\u0131ndan<br \/>\nku\u015fku duymuyorduk. B\u00f6ylesi bir s\u00fcre\u00e7 ya\u015fanmadan ne kimlik ne de \u00f6zg\u00fcrl\u00fck s\u00f6z<br \/>\nkonusu olabilirdi. Bu ama\u00e7la daha ilk ba\u015flarda tarihsel toplumda zorun i\u015flevi<br \/>\n\u00fczerinde yo\u011funla\u015fmaya \u00e7al\u0131\u015f\u0131yorduk. Kald\u0131 ki, her g\u00fcn, her saat iliklerimize<br \/>\nkadar kendini hissettiren \u00e7\u0131plak zor g\u00fc\u00e7leri meydandayd\u0131. Zorla fetih sadece<br \/>\nbir egemenlik hakk\u0131 olarak de\u011fil, Allah\u2019\u0131n emrinin gere\u011fi de say\u0131l\u0131yordu.<br \/>\nGenelde oldu\u011fu gibi, K\u00fcrdistan \u00fczerinde egemenlik kuran g\u00fc\u00e7lerin geleneksel<br \/>\noldu\u011fu kadar Moderniteye dayal\u0131 idealar\u0131 da bu y\u00f6nl\u00fcyd\u00fc. K\u00fcrdistan ge\u00e7mi\u015ften<br \/>\nberi fethedilmi\u015f bir \u00fclke veya toprak par\u00e7as\u0131yd\u0131. Tanr\u0131n\u0131n emrinin gerekleri<br \/>\nyerine getirilmi\u015fti. Modernite unsurlar\u0131 s\u00f6z konusu oldu\u011funda ilave<br \/>\ngerek\u00e7elerle egemenlik hakk\u0131 asla tart\u0131\u015f\u0131lmazd\u0131. Azami k\u00e2r kanunu ve<br \/>\nsanayile\u015fme ihtiya\u00e7lar\u0131 geni\u015f topraklar\u0131 ve pazarlar\u0131 zorunlu k\u0131l\u0131yordu.<br \/>\nUlus-devlet\u00e7i egemenlik anlay\u0131\u015f\u0131, asla b\u00f6l\u00fcnmez ve ba\u015fkalar\u0131yla payla\u015f\u0131lmaz g\u00fc\u00e7<br \/>\nteorisine dayan\u0131yordu. S\u0131n\u0131rlar\u0131n bir kar\u0131\u015f\u0131yla dahi oynanmazd\u0131. Bir \u00e7ak\u0131l ta\u015f\u0131<br \/>\nbile verilemezdi. Adeta ol deyince olduran bir tanr\u0131sall\u0131k, daha do\u011frusu<br \/>\nulus-devlet tanr\u0131sall\u0131\u011f\u0131 kendisini eski tanr\u0131sall\u0131klardan bin kat daha fazla<br \/>\ng\u00fc\u00e7lendirilmi\u015f egemenlik, merkezi g\u00fc\u00e7, homojen toplum, mutlak k\u00f6le vatanda\u015f ve<br \/>\nher konudaki tek\u00e7i (\u2018tek vatan\u2019, \u2018tek dil\u2019, \u2018tek k\u00fclt\u00fcr\u2019, \u2018tek bayrak\u2019, \u2018tek<br \/>\nmar\u015f\u2019 vb.) anlay\u0131\u015flar ve emrindeki g\u00fc\u00e7lerle tart\u0131\u015f\u0131lmaz k\u0131l\u0131yordu. En ufak bir<br \/>\ntart\u0131\u015fma ve kar\u015f\u0131 tez, \u2018vatan\u0131n birlik ve b\u00fct\u00fcnl\u00fc\u011f\u00fc \u2019ne y\u00f6nelik en tehlikeli<br \/>\nsu\u00e7 olarak yarg\u0131lan\u0131yor ve en a\u011f\u0131r cezayla cezaland\u0131r\u0131l\u0131yordu. B\u00f6ylesi<br \/>\nko\u015fullar\u0131n b\u00fct\u00fcn s\u00f6ylem ve eylemleriyle kendisini konu\u015fturdu\u011fu ve ge\u00e7erli<br \/>\nk\u0131ld\u0131\u011f\u0131 bir ortamda en ufak bir kar\u015f\u0131 ideada bulunmak, ancak kendini zor<br \/>\ny\u00f6ntemleriyle savunmakla m\u00fcmk\u00fcn olabilirdi. Bu tart\u0131\u015f\u0131lm\u0131yordu. Tart\u0131\u015fma bunun<br \/>\nstratejik ve taktik gereklerine ili\u015fkindi. Nitekim PKK\u2019nin \u00e7\u0131k\u0131\u015f d\u00f6neminde<br \/>\nme\u015fru savunma ara\u00e7lar\u0131 teredd\u00fcts\u00fcz kullan\u0131lm\u0131\u015ft\u0131. PKK bir nevi milis g\u00fc\u00e7 olarak<br \/>\nkendisini \u00f6rg\u00fctlemek zorundayd\u0131. Aksi halde bir g\u00fcn bile ayakta kalamazd\u0131.<br \/>\nKalsa bile di\u011fer g\u00fc\u00e7lerden fark\u0131 kalmaz ve tasfiye olmaktan kurtulamazd\u0131.  (A.<br \/>\n\u00d6calan)<\/strong><\/p>\n<p> Bu do\u011frultuda<br \/>\nde\u011ferlendirildi\u011finde \u00f6zg\u00fcrl\u00fck, demokrasi ve ulusal kurtulu\u015f sava\u015flar\u0131 \u00f6z\u00fcnde<br \/>\nme\u015fru m\u00fcdafaa sava\u015flar\u0131d\u0131r. \u00c7a\u011f\u0131m\u0131zda egemen sistemlerinde yads\u0131yamad\u0131\u011f\u0131 temel<br \/>\nbir ger\u00e7eklik olan me\u015fru savunma  insanl\u0131\u011f\u0131n, zorbal\u0131k, zul\u00fcm, s\u00f6m\u00fcr\u00fc, i\u015fgal,<br \/>\ni\u015fkence, talan vb. haks\u0131z ve insanl\u0131k d\u0131\u015f\u0131 uygulamalar kar\u015f\u0131s\u0131nda direnmesi,<br \/>\nkar\u015f\u0131 koymas\u0131 ve kendini savunmas\u0131 bak\u0131m\u0131ndan herkesin kabul etti\u011fi ve<br \/>\nuluslararas\u0131 anla\u015fma ve s\u00f6zle\u015fmelerle \u00e7er\u00e7evelenmi\u015f bir husustur. Bu hak hem<br \/>\nbireyler hem de toplumlar a\u00e7\u0131s\u0131ndan ge\u00e7erlidir. K\u00fcrdistan halk\u0131 durumundaki<br \/>\ns\u00f6m\u00fcrgele\u015ftirilmi\u015f \u00fclkelerde me\u015fru savunma hususu net tan\u0131m ve \u00f6l\u00e7\u00fclere<br \/>\nkavu\u015fturulmu\u015ftur. <\/p>\n<p> Ulusal Kurtulu\u015f M\u00fccadeleleri<br \/>\nsonucu ba\u011f\u0131ms\u0131zl\u0131klar\u0131n\u0131 kazanan uluslar kendi devletleriyle BM\u2019ye kabul<br \/>\nedildiler. Bunu sa\u011flayan ba\u011f\u0131ms\u0131zl\u0131k, e\u015fitlik ve \u00f6zg\u00fcrce kendi kaderini tayin<br \/>\nhakk\u0131 da do\u011fal olarak BM belgelerinde yer almaya ba\u015flad\u0131. Ve genel bir \u00f6l\u00e7\u00fc<br \/>\nhaline geldi. B\u00f6ylece ezilen halklar kendi g\u00fcc\u00fcyle b\u00fcy\u00fck bedeller pahas\u0131na<br \/>\nger\u00e7ekle\u015ftirdi\u011fi m\u00fccadele sonucu me\u015fru savunma sava\u015f\u0131n\u0131 uluslararas\u0131 hukukun<br \/>\ntemel bir hakk\u0131 haline getirmi\u015f oldu. S\u0131n\u0131f m\u00fccadeleleri siyasal, ekonomik ve<br \/>\nsosyal haklar\u0131n\u0131 geli\u015ftirip demokratik hukuka kavu\u015ftururken, ulusal kurtulu\u015f<br \/>\nm\u00fccadeleleri de halklar\u0131n toplumsal, k\u00fclt\u00fcrel, ulusal ve ba\u011f\u0131ms\u0131zl\u0131k haklar\u0131n\u0131<br \/>\nhukuk g\u00fcvencesine ald\u0131. <\/p>\n<p> Zaten anti-s\u00f6m\u00fcrgeci<br \/>\nhareketlerin, m\u00fccadelelerin uluslararas\u0131 hukuktaki me\u015frutiyetini ve temelini bu<br \/>\nhak olu\u015fturmu\u015ftur. Nitekim bu hukuki hak ilk defa ifadesini Aral\u0131k 1960 y\u0131l\u0131nda<br \/>\n18 yeni ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 kazanm\u0131\u015f \u00fclkelerin \u00fcye oldu\u011fu 15. BM Genel Kurulunda<br \/>\nal\u0131nan 1514 say\u0131l\u0131 s\u00f6m\u00fcrgecili\u011fin Tasfiyesi Deklarasyonunda bulmu\u015ftur. Bu<br \/>\ndeklarasyonun \u00e7er\u00e7evesi \u015f\u00f6yledir:<\/p>\n<p> <strong>1-Halklar\u0131 h\u00e2kimiyetine, yabanc\u0131 boyunduru\u011fu alt\u0131na alma ve s\u00f6m\u00fcr\u00fcye<br \/>\ntabi tutma, temel insan haklar\u0131n\u0131 \u00e7i\u011fnemek, kabul etmemek anlam\u0131na gelir. Bu<br \/>\ndurum BM \u015fart\u0131na ayk\u0131r\u0131l\u0131k arz etti\u011fi gibi, d\u00fcnya bar\u0131\u015f\u0131 davas\u0131na zarar<br \/>\nvermektedir.<\/strong><\/p>\n<p> <strong>2-B\u00fct\u00fcn halklar kendi kaderini tayin etme hakk\u0131na sahiptir. Bu hak<br \/>\ntemelinde \u00f6zg\u00fcrce politik stat\u00fclerini belirlerler ve onu \u00f6zg\u00fcrce<br \/>\n\u015fekillendirebilirler.<\/strong><\/p>\n<p> Bu deklarasyon halklar\u0131n bir<br \/>\nba\u015far\u0131s\u0131yd\u0131 ve BM \u015fart\u0131nda var olan kendi kaderini tayin ve bunun i\u00e7in direnme,<br \/>\nsava\u015f y\u00fcr\u00fctme hakk\u0131n\u0131 tutarl\u0131 bir \u015fekilde somutla\u015ft\u0131rd\u0131.<span>\u00a0 <\/span>Bu kararname \u00f6zellikle ulusal kurtulu\u015f<br \/>\nm\u00fccadelesinin me\u015frulu\u011funu g\u00f6sterme yolunda \u00f6nemli bir geli\u015fme olmu\u015ftur ve<br \/>\nhalklar\u0131n can\u0131, kan\u0131 pahas\u0131na g\u00f6rkemli direni\u015flerle elde edilmi\u015ftir.<br \/>\nDeklarasyonun en \u00f6nemli y\u00f6n\u00fc yabanc\u0131 i\u015fgali\/h\u00e2kimiyeti alt\u0131nda bulunma\/tutulma<br \/>\nolgusunu yani \u201ci\u015fgal  ile \u201cinsan haklar\u0131  aras\u0131nda do\u011frudan ba\u011f kurmas\u0131d\u0131r. <\/p>\n<p> 1966 y\u0131l\u0131na gelindi\u011finde ise BM<br \/>\nGenel Kurulu Kendi Kaderini tayin hakk\u0131n\u0131 iki insan haklar\u0131 \u00e7er\u00e7eve<br \/>\ns\u00f6zle\u015fmesinin ba\u015f\u0131na koydu. Ekonomik, Sosyal ve K\u00fclt\u00fcrel Haklara dair<br \/>\nUluslararas\u0131 s\u00f6zle\u015fme ile Medeni ve siyasi haklara ili\u015fkin Uluslararas\u0131<br \/>\nS\u00f6zle\u015fmesi\u2019nin 1. Maddeleri \u015fu \u015fekilde form\u00fcle edildi:<\/p>\n<p> <strong>\u201cB\u00fct\u00fcn Halklar Kendi Kaderini tayin etme hakk\u0131na sahiptir. Bu hak<br \/>\nsayesinde \u00f6zg\u00fcrce siyasal stat\u00fclerini belirler. Ve \u00f6zg\u00fcrce ekonomik, sosyal ve<br \/>\nk\u00fclt\u00fcrel geli\u015fmelerine bi\u00e7im verebilirler. <\/strong><\/p>\n<p> 1970 y\u0131l\u0131nda BM\u2019de kabul edilen<br \/>\nba\u015fka bir deklarasyon yukar\u0131daki iki \u00e7er\u00e7eve s\u00f6zle\u015fmeye ba\u011fl\u0131 olarak halklar\u0131n<br \/>\nhangi yollarla kendi kaderini belirleyeceklerini metinsel (hukuki) g\u00fcvenceye<br \/>\nkavu\u015fmu\u015ftur. <\/p>\n<p> Buna g\u00f6re: <\/p>\n<p> <strong>\u201cKendi kaderini tayin hakk\u0131n\u0131n ger\u00e7ekle\u015ftirilmesi yollar\u0131: Egemen ve<br \/>\nba\u011f\u0131ms\u0131z bir devlet kurulmas\u0131, ba\u015fka bir ba\u011f\u0131ms\u0131z devletle birle\u015fme, b\u00f6yle bir<br \/>\ndevlete \u00fcye olmak ya da halk\u0131n \u00f6zg\u00fcr karar\u0131yla belirli ba\u015fka siyasal stat\u00fcn\u00fcn<br \/>\nolu\u015fmas\u0131 kendi kaderini tayin etme hakk\u0131n\u0131n ger\u00e7ekle\u015ftirilme yollar\u0131n\u0131 ifade<br \/>\neder. <\/strong><\/p>\n<p> Bu s\u00f6zle\u015fmeler kendi kaderini<br \/>\ntayin hakk\u0131n\u0131 sadece uluslararas\u0131 hukuk ve ili\u015fkilerde bir siyasal prensip ya<br \/>\nda ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olmayan bir ilke de\u011fil, uluslararas\u0131 ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olan<br \/>\nemredici bir hukuk kural\u0131 haline getirmi\u015ftir.<\/p>\n<p> 27 Haziran 1981 tarihinde \u0130nsan<br \/>\nHaklar\u0131 ve Halklar\u0131n Haklar\u0131na ili\u015fkin Afrika \u015fart\u0131 imzaland\u0131. Bu \u015fart\u0131n 20.<br \/>\nMaddesi:<\/p>\n<p> <strong>\u201cB\u00fct\u00fcn halklar var olma hakk\u0131na sahiptirler. Onlar\u0131n tart\u0131\u015fmas\u0131z ve<br \/>\nvazge\u00e7ilmez olarak kendi kaderini tayin etme haklar\u0131 vard\u0131r. Halklar \u00f6zg\u00fcrce<br \/>\npolitik stat\u00fclerini belirler ve ekonomik, sosyal, k\u00fclt\u00fcrel geli\u015fmelerini yine<br \/>\nkendi iradeleriyle belirledikleri politikaya g\u00f6re \u015fekillendirirler <\/strong><br \/>\ndemektedir.<\/p>\n<p> \u0130rdeledi\u011fimiz s\u00f6zle\u015fmeler<br \/>\nekseninde halklar\u0131n kendi kaderini tayin iki \u015fekilde ger\u00e7ekle\u015fmektedir. Bunlar:<br \/>\nAyr\u0131lmay\u0131 ifade eden \u201cD\u0131\u015fsal kendi kaderini tayin hakk\u0131  ile \u00f6zg\u00fcr ve e\u015fit<br \/>\nbirlikteli\u011fi ifade eden \u201ci\u00e7sel kendi kaderini tayin hakk\u0131  d\u0131r. Bunlar\u0131n<br \/>\ntercihi halklar\u0131n ve topluluklar\u0131n ortak istemine ve iradesine ba\u011fl\u0131d\u0131r.<\/p>\n<p> 1-<strong>Ba\u011f\u0131ms\u0131zl\u0131k \u0130lkesi: Ayr\u0131lma ile Kendi Kaderini Tayin Hakk\u0131<\/strong><\/p>\n<p> <strong>T\u00fcr olarak evrensel hukukta <\/strong>\u201cd\u0131\u015fsal<br \/>\nkendi kaderini tayin hakk\u0131  tarz\u0131nda tan\u0131mlanm\u0131\u015ft\u0131r.<strong> <\/strong>Burada <span>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 <\/span>\u201cAyr\u0131lma  ve \u201cba\u011f\u0131ms\u0131z  olma<br \/>\ntemel kriterdir. Ayr\u0131lma yerine bulunulan devlet s\u0131n\u0131rlar\u0131<br \/>\nitibariyle \u201cotonomi,  G\u00fc\u00e7lendirilmi\u015f yerel y\u00f6netimler , \u201cFedere Birimler  veya<br \/>\nuzun s\u00fcre g\u00fcndemde olan \u201cDemokratik \u00d6zerklik  \u015feklinde ger\u00e7ekle\u015fmektedir.<\/p>\n<p> Yukar\u0131da inceledi\u011fimiz evrensel<br \/>\nhukuk normlar\u0131na g\u00f6re  benzer sorunu ya\u015fayan her ulusal ve etnik toplulu\u011fun<\/p>\n<p> <strong>1-Egemen ve Ba\u011f\u0131ms\u0131z bir devlet kurma hakk\u0131<\/strong><\/p>\n<p> <strong>2-Ba\u015fka bir devletle birle\u015fme veya \u00fcye olma hakk\u0131<\/strong><\/p>\n<p> <strong>3-Halk\u0131n \u00f6zg\u00fcr karar\u0131yla ayr\u0131lma veya birlik temelinde ba\u015fka bir siyasi<br \/>\nstat\u00fcyle kendi kaderini tayin hakk\u0131.<\/strong><\/p>\n<p> Bu me\u015fru haklar i\u00e7in zorunlu<br \/>\nhallerde me\u015fru savunma temelinde sava\u015f y\u00fcr\u00fct\u00fclebilir.<\/p>\n<p> Bu bak\u0131mdan K\u00fcrdistan\u2019da fa\u015fist<br \/>\nT\u00fcrk i\u015fgalci sistemine kar\u015f\u0131 geli\u015fen Demokratik \u00f6z y\u00f6netimler direni\u015fi her<br \/>\na\u00e7\u0131dan hakl\u0131 olup evrensel demokratik hukuk normlar\u0131na g\u00f6re de me\u015frudur. Bunun<br \/>\nda \u00f6tesinde K\u00fcrt halk\u0131 bu \u015famada Ba\u011f\u0131ms\u0131z demokratik bir \u00fclke kurma hakk\u0131na<br \/>\nsahiptir ve bu se\u00e7enek t\u00fcm siyasal kanallar\u0131n t\u00fckendi\u011fi bu a\u015famada g\u00fcndeme<br \/>\ngelmelidir. Fa\u015fizmin h\u00fck\u00fcm s\u00fcrd\u00fc\u011f\u00fc bir \u00fclkede mutlak yap\u0131lmas\u0131 gereken<br \/>\ndirenmektir ve \u00f6z savunma ara\u00e7lar\u0131n\u0131 en etkili bir \u015fekilde kullanmakt\u0131r. <\/p>\n<p> \u0130\u00e7sel kendi kaderini tayin hakk\u0131<br \/>\ntercihi ancak demokrasi kanallar\u0131n\u0131n a\u00e7\u0131k oldu\u011fu, uzla\u015f\u0131 ve bar\u0131\u015f ara\u00e7lar\u0131n\u0131n<br \/>\nsiyasette etkin kullan\u0131ld\u0131\u011f\u0131 bunlar\u0131n Anayasal g\u00fcvenceye al\u0131nd\u0131\u011f\u0131 ko\u015fullarda<br \/>\nger\u00e7ekle\u015fir. Model olarak ihtiya\u00e7 ve \u00f6zg\u00fcnl\u00fcklere g\u00f6re de\u011fi\u015fkenlik arz<br \/>\nedebilir. \u00d6rne\u011fin  K\u00fcrtler Demokratik Cumhuriyet temelinde Demokratik \u00d6zerklik<br \/>\n\u00e7\u00f6z\u00fcm\u00fc ve talebini \u00f6ne s\u00fcrm\u00fc\u015flerdir. Devlet\u00e7i paradigmaya dayal\u0131 bir \u00e7\u00f6z\u00fcm<br \/>\nyerine demokrasiye ve Demokratik Topluma dayal\u0131 bir toplumsal ve ulusal<br \/>\n\u00f6rg\u00fctl\u00fcl\u00fc\u011f\u00fc esas alm\u0131\u015flard\u0131r. Bunu Demokratik Ulus olarak projelendirmi\u015flerdir.<br \/>\nT\u00fcm K\u00fcrdistan par\u00e7alar\u0131 bak\u0131m\u0131ndan ise Demokratik Konfederalizm bi\u00e7iminde<br \/>\nsomutluk kazanm\u0131\u015ft\u0131r. Evrensel hukukta bu s\u00fcre\u00e7 \u201ci\u00e7sel kendi kaderini tayin<br \/>\nhakk\u0131  olarak ifadesini bulur. Yani b\u00fct\u00fcnl\u00fck i\u00e7inde demokratik \u00e7\u00f6z\u00fcm anlam\u0131na<br \/>\ngelir. PKK \u00f6nderli\u011finin \u0131srarla geli\u015ftirmek istedi\u011fi ancak s\u00f6m\u00fcrgeci T\u00fcrk<br \/>\ndevletinin yana\u015fmad\u0131\u011f\u0131 bu \u00e7\u00f6z\u00fcm bi\u00e7imidir.<\/p>\n<p> K\u00fcrt Halk \u00f6nderi A. \u00d6calan<br \/>\nK\u00fcrtlerin tayin hakk\u0131n\u0131 \u015f\u00f6yle form\u00fcle etmektedir.<\/p>\n<p> <strong>\u201cK\u00fcrdistan i\u00e7inse kendi kaderini tayin hakk\u0131 milliyet\u00e7i temelde devlet<br \/>\nkurmak de\u011fil, mevcut s\u0131n\u0131rlar\u0131 sorun yapmadan ve s\u0131n\u0131rlar\u0131 esas almadan kendi<br \/>\ndemokrasisini kurma hareketidir. \u0130ran\u2019da, Suriye\u2019de, T\u00fcrkiye\u2019de ve hatta<br \/>\nIrak\u2019ta olu\u015facak bir K\u00fcrt yap\u0131lanmas\u0131nda t\u00fcm K\u00fcrtler bir araya gelerek kendi<br \/>\nfederasyonlar\u0131n\u0131, birle\u015ferek de bir \u00fcst konfederasyonlar\u0131n olu\u015ftururlar.<\/strong><\/p>\n<p> <strong>Demokratik Konfederalizm d\u00f6rt par\u00e7aya b\u00f6l\u00fcnm\u00fc\u015f ve d\u00fcnyan\u0131n her taraf\u0131na<br \/>\nyay\u0131lm\u0131\u015f olan K\u00fcrt halk\u0131n\u0131n Demokratik birli\u011finin ifadesidir. K\u00fcrt ulusunun<br \/>\nkendi i\u00e7indeki sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde demokratik birlik ilkesini esas al\u0131r.<br \/>\nMilliyet\u00e7ilik temelindeki devletle\u015fme e\u011filimlerini, \u00e7a\u011f\u0131n\u0131 doldurmu\u015f<br \/>\nulus-devlet anlay\u0131\u015f\u0131n\u0131n devam\u0131 olarak g\u00f6r\u00fcr. Bu t\u00fcr \u00e7\u00f6z\u00fcmler K\u00fcrt sorununu<br \/>\n\u00e7\u00f6zmede ve K\u00fcrt toplumunu ilerletmede yeterli olmayaca\u011f\u0131 i\u00e7in b\u00f6ylesi g\u00fc\u00e7lerin<br \/>\ndemokrasiye, demokratikle\u015fmeye a\u00e7\u0131k olmaya ve demokratik ulus birli\u011fi temelinde<br \/>\nkonfederasyona kat\u0131lmaya davet ediyorum. Demokratik Konfederalizm, demokratik<br \/>\nderin zihniyete ve \u00f6zg\u00fcrl\u00fck bilincine dayand\u0131\u011f\u0131 halklar aras\u0131nda hi\u00e7bir ayr\u0131m<br \/>\nyapmadan, t\u00fcm halklar\u0131n e\u015fit-\u00f6zg\u00fcr birli\u011fini esas al\u0131r. Kat\u0131 s\u0131n\u0131rlara dayal\u0131<br \/>\nmilliyet\u00e7i-devlet\u00e7i ulus yerine demokratik ulusu geli\u015ftirir. Bu temelde t\u00fcm<br \/>\nOrtado\u011fu halklar\u0131n\u0131n ve demokrasi g\u00fc\u00e7lerinin birle\u015fmesinden yanad\u0131r. Kom\u015fu<br \/>\ndevletler ile ili\u015fkileri, e\u015fit ve \u00f6zg\u00fcr birlik ilkesine dayal\u0131 olarak siyasal,<br \/>\nsosyal ve k\u00fclt\u00fcrel haklar\u0131n ya\u015famsalla\u015ft\u0131r\u0131lmas\u0131 temelinde d\u00fczenlemeyi<br \/>\n\u00f6ng\u00f6r\u00fcr. <\/strong><\/p>\n<p> PKK \u00d6nderli\u011fi Stratejik olarak<br \/>\ngeli\u015ftirdi\u011fi KCK sistemine ba\u011fl\u0131 olarak g\u00fcncel \u00e7\u00f6z\u00fcm olarak da <strong>Demokratik \u00d6zerklik<\/strong> projesini<br \/>\nsomutla\u015ft\u0131rd\u0131. Me\u015fru savunma sava\u015f\u0131m\u0131n\u0131 da bu paralelde d\u00fczenledi.<\/p>\n<p> Yeni paradigmas\u0131 do\u011frultusunda<br \/>\niktidar, devlet, sava\u015f, \u015fiddet ve zor olgular\u0131n\u0131 derin bir \u00e7\u00f6z\u00fcmlemesini<br \/>\nyaparak insanl\u0131\u011fa ve do\u011faya kaybettirdiklerinden ders \u00e7\u0131kararak yeni me\u015fru<br \/>\nsavunma \u00e7izgisini geli\u015ftirmi\u015ftir. Yine ge\u00e7mi\u015f sava\u015f s\u00fcrecinde<br \/>\niktidarc\u0131-devlet\u00e7i ve milliyet\u00e7i paradigmalara ba\u011fl\u0131 olarak ortaya \u00e7\u0131kan,<br \/>\namac\u0131n\u0131 a\u015fan \u015fiddet ve sava\u015f tarzlar\u0131n\u0131 mahk\u00fbm ederek yeni bir anlay\u0131\u015fa<br \/>\nula\u015fm\u0131\u015ft\u0131r. Bu \u00e7er\u00e7evede me\u015fru savunma \u00e7izgisinde BM, Cenevre S\u00f6zle\u015fmesi\u2019ne ve<br \/>\nLahey Adalet Divan\u0131 Kararlar\u0131na uymay\u0131 taahh\u00fct etmi\u015f ve me\u015fru savunma sava\u015f\u0131n\u0131n<br \/>\ngenel h\u00fck\u00fcmlerini belirlemi\u015ftir. <\/p>\n<p> Bu H\u00fck\u00fcmlere g\u00f6re  Me\u015fru savunma<br \/>\nsava\u015f\u0131, temelde do\u011fal demokratik insani haklar\u0131n kullan\u0131lmas\u0131na d\u00f6n\u00fck bir \u00e7\u00f6z\u00fcm<br \/>\nm\u00fccadelesidir. Sava\u015fa ancak k\u00f6rd\u00fc\u011f\u00fcm olmu\u015f sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne katk\u0131 sunmak ve<br \/>\npolitik t\u0131kan\u0131kl\u0131klar\u0131 a\u00e7mak i\u00e7in ba\u015fvurulur. Me\u015fru savunma stratejisinde<br \/>\nama\u00e7s\u0131z, feti\u015fle\u015ftirilmi\u015f bir \u015fiddet anlay\u0131\u015f\u0131 yoktur. Aksine me\u015fru savunma<br \/>\nsiyasi \u00e7\u00f6z\u00fcm \u00fc geli\u015ftirecek, hukuka ba\u011fl\u0131 bir zorunlu m\u00fccadele stratejisidir<\/p>\n<p> Me\u015fru savunma sava\u015f\u0131nda<br \/>\ndevletlerin zor \u00f6rg\u00fctleri, sava\u015f kurumlar\u0131 ve silahl\u0131 g\u00fc\u00e7leriyle buna destek<br \/>\nolan kontra \u00f6rg\u00fctler, fiilen sava\u015fa kat\u0131lan, rant\u00e7\u0131l\u0131\u011f\u0131 yapan, sivil halka<br \/>\ny\u00f6nelen kurumlar hedeftir.<\/p>\n<p> Me\u015fru savunma kapsam\u0131nda<br \/>\nmisilleme hakk\u0131 vard\u0131. Her halk ulusal, k\u00fclt\u00fcrel de\u011ferlerine sald\u0131r\u0131 ve imha<br \/>\ntehdidi kar\u015f\u0131s\u0131nda kendini savunma hakk\u0131na sahiptir.
