Onun i\u00e7in af olay\u0131na siyasal olmaktan \u00e7ok toplumsal ve<br \/>\nvicdani olarak bakmak \u00f6nemlidir. \u015eimdiye kadar aff\u0131 siyasal iktidarlar ya da<br \/>\ny\u00f6netimler \u00e7\u0131karm\u0131\u015ft\u0131r. Bu aflarla genelde ya bir \u015feyleri saklamak, oyalamak ya<br \/>\nda gelecekte bela olabilecek bir \u015feylerden kurtulmak gibi bir ama\u00e7 g\u00fcd\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p class=\" \">Bir\u00e7ok \u00fclkede af, devlet su\u00e7lar\u0131n\u0131n \u00f6rtbas edilmesi ve<br \/>\ndevletin a\u00e7\u0131\u011fa \u00e7\u0131kan ceberut y\u00fcz\u00fcn\u00fcn yeniden \u015fefkatli olarak g\u00f6sterilmesini<br \/>\nsa\u011flamak i\u00e7in \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Yani toplum ve tarih kar\u015f\u0131s\u0131nda af edilmesi<br \/>\ngerekenler, kendilerine tanr\u0131sal aldat\u0131c\u0131 bir af misyonu y\u00fcklemi\u015flerdir. Ama<br \/>\nbug\u00fcnk\u00fc geli\u015fmeler de g\u00f6steriyor ki, m\u0131zrak art\u0131k \u00e7uvala s\u0131\u011fm\u0131yor. Belki af,<br \/>\n\u00f6rg\u00fcts\u00fcz topluluklar i\u00e7in bir aldatma yolu olabilir, ama \u00f6rg\u00fctl\u00fc-bilin\u00e7li<br \/>\ntopluluklar\u0131n b\u00f6ylesi bir yan\u0131lg\u0131ya d\u00fc\u015fmesi art\u0131k m\u00fcmk\u00fcn g\u00f6r\u00fcnm\u00fcyor. Bu anlamda<br \/>\naf, \u00e7at\u0131\u015fmal\u0131 ortamlar\u0131n durdurulmas\u0131 ve \u00f6zg\u00fcrl\u00fc\u011fe dayal\u0131 bar\u0131\u015f, uzla\u015f\u0131 ve<br \/>\ndemokrasi k\u00fclt\u00fcr\u00fcn\u00fcn geli\u015ftirilmesinde olu\u015fturulacak projeler b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn bir<br \/>\npar\u00e7as\u0131 olarak ko\u015fullara g\u00f6re \u00f6zg\u00fcnl\u00fc\u011f\u00fc i\u00e7inde ele al\u0131n\u0131p de\u011ferlendirilebilir.<br \/>\nAma belirtilenin d\u0131\u015f\u0131nda geleneksel af yakla\u015f\u0131m\u0131n\u0131, toplumun demokratikle\u015fme<br \/>\nm\u00fccadelesinde bir yere koymak m\u00fcmk\u00fcn de\u011fildir. Ya\u015fananlardan da g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi<br \/>\naksine bir i\u015flev g\u00f6r\u00fcyorlar. Onun i\u00e7in Pinochet\u2019 nin aff\u0131 ile Ecevit ya da<br \/>\nRah\u015fan aflar\u0131 veya \u00d6zal \u2018sal\u0131vermesi\u2019 aras\u0131nda ciddi bir ayr\u0131m yoktur. <\/p>\n<p class=\" \">Affa bunun d\u0131\u015f\u0131nda bir yakla\u015f\u0131m ise Guetemala\u2019da 1987<br \/>\ny\u0131l\u0131nda \u00e7\u0131kar\u0131lan \u2018af\u2019 da g\u00f6r\u00fcld\u00fc. Guatemala h\u00fck\u00fcmeti 1987 y\u0131l\u0131nda bir genel af<br \/>\nilan etti. Genel af sadece URNG\u2019nin t\u00fcm \u00fcyelerinin teslim olmas\u0131 ve silahlar\u0131n\u0131<br \/>\nb\u0131rakmalar\u0131n\u0131 hedefliyordu.<span>\u00a0 <\/span>URNG bunu<br \/>\nkabul etmedi. Bu giri\u015fim kar\u015f\u0131s\u0131nda URNG, \u2018\u00fclkede demokratik bir sistemin ve<br \/>\nyerli haklar\u0131n\u0131n anayasal g\u00fcvenceye al\u0131nmamas\u0131 durumunda hi\u00e7bir \u015fekilde silah<br \/>\nb\u0131rakmayaca\u011f\u0131n\u0131\u2019 duyurdu. Bu af perspektifi, uzun bir d\u00f6nem taraflar aras\u0131 t\u00fcm<br \/>\ng\u00f6r\u00fc\u015fmelerde masaya ilk \u015fart olarak getirildi. Bu perspektif URNG\u2019ye \u2018teslim<br \/>\nolmay\u0131 ve silahlar\u0131 b\u0131rakmay\u0131\u2019 dayat\u0131yordu. <\/p>\n<p class=\" \">\u00a0<\/p>\n<p class=\" \">Bar\u0131\u015f\u0131n Teminat\u0131 Hakikat Komisyonlar\u0131 <\/p>\n<p class=\" \">G\u00fcney Afrika\u2019da Hakikat Komisyonlar\u0131n\u0131n g\u00fcndeme getirdi\u011fi af<br \/>\nyakla\u015f\u0131m\u0131, d\u00fcnyada \u015fimdiye kadar g\u00fcndeme getirilen t\u00fcm af uygulamalar\u0131ndan<br \/>\nfarkl\u0131 bir yakla\u015f\u0131m\u0131 a\u00e7\u0131\u011fa \u00e7\u0131kard\u0131. G\u00fcney Afrika Hakikat Komisyonu, \u2018hakikate<br \/>\nkar\u015f\u0131l\u0131k af\u2019 \u015feklinde form\u00fcle edilebilecek bir uygulamay\u0131 g\u00fcndeme getirmi\u015fti.<br \/>\nBu af t\u00fcr\u00fc bireysel ba\u015fvuru temelinde bireylere uygulanm\u0131\u015ft\u0131. Bu form\u00fclasyonda,<br \/>\nsu\u00e7lunun aff\u0131nda ma\u011fdurlar\u0131n da istemi belirleyici durumdayd\u0131. Yani belirleyici<br \/>\nolan toplumdu. T\u00fcrkiye\u2019de de mevcut ya\u015fanm\u0131\u015fl\u0131klar\u0131n bir tamirini yapmak i\u00e7in<br \/>\nbir af d\u00fc\u015f\u00fcn\u00fcl\u00fcyorsa bu ancak G\u00fcney Afrika\u2019daki Hakikatleri Ara\u015ft\u0131rma ve Uzla\u015fma<br \/>\nmodeliyle olabilir. <\/p>\n<p class=\" \">Bu \u00e7al\u0131\u015fmalar\u0131n esas\u0131n\u0131 insan haklar\u0131 ihlalleri<br \/>\nolu\u015fturmal\u0131d\u0131r. Fakat sosyal bir varl\u0131k olarak insan toplumsuz ele<br \/>\nal\u0131namayacaksa, insan haklar\u0131 ihlalleri de insan\u0131 sadece birey olarak ele<br \/>\nalmaya m\u00fcsaade etmemektedir. Bundan dolay\u0131 insan\u0131 i\u00e7inde ya\u015fad\u0131\u011f\u0131 toplumla<br \/>\nbirlikte ele almak ve topluluk haklar\u0131 kar\u015f\u0131s\u0131nda i\u015flenen su\u00e7lara da bu \u00e7al\u0131\u015fma<br \/>\nkapsam\u0131nda yer vermek bir zorunluluktur. Topluluk haklar\u0131yla kastedilen ise<br \/>\nki\u015finin etnik kimli\u011finden kaynakl\u0131 sahip oldu\u011fu inan\u00e7, dil ve rengi ve siyasal<br \/>\ngrup olmaktan kaynakl\u0131 benimsedi\u011fi ekonomik, sosyal, siyasal ve k\u00fclt\u00fcrel<br \/>\nhaklard\u0131r. <\/p>\n<p class=\" \">Benzer bir yakla\u015f\u0131m\u0131n t\u00fcm insanl\u0131\u011f\u0131n ve canl\u0131lar\u0131n i\u00e7inde<br \/>\nya\u015fad\u0131\u011f\u0131 do\u011faya kar\u015f\u0131 da g\u00f6sterilmesi gerekiyor. \u00c7\u00fcnk\u00fc do\u011fay\u0131 kendi ki\u015fisel<br \/>\n\u00e7\u0131karlar\u0131na kurban eden bir kesim y\u00fcz\u00fcnden ekolojik denge h\u0131zla bozulmakta ve<br \/>\nt\u00fcm canl\u0131lar\u0131n ya\u015fam\u0131 tehdit edilmektedir. Do\u011fa t\u00fcm canl\u0131lar\u0131n ve insanl\u0131\u011f\u0131n<br \/>\nortak de\u011feriyse, do\u011fay\u0131 tahrip etmek ve canl\u0131 ya\u015fam\u0131n\u0131 tehdit eden sa\u011fl\u0131ks\u0131z<br \/>\nortama neden olmak da bir gasp ve katliam bi\u00e7imidir.
